You also have the right to request the restriction of the processing of your personal data in certain circumstances. In addition, you have the right to lodge a complaint with the competent supervisory authority.

You can contact us at any time regarding this and any other questions on the subject of data protection.

Analysis tools and third-party tools

3. General notes and mandatory information

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this data protection declaration.

When you use this website, various personal data are collected. Personal data is data by which you can be personally identified. This privacy policy explains what information we collect and how we use it. It also explains how and for what purpose this is done.

We would like to point out that the transmission of data over the Internet (e.g. when communicating by e-mail) may have security gaps. Complete protection of data against access by third parties is not possible.

On our website we use static links to our social media presences, namely YouTube, Xing and LinkedIn . These are buttons that are linked to static links. Clicking the corresponding button only takes you to our page on the respective social network. This does not result in the sharing of content or the transfer of personal data to the respective social network.

Note on the office responsible

The responsible party for data processing on this website is:

VLEXsoftware+consulting gmbh
Fritz-Hornschuch-Straße 12

Phone: 09221 69177-0
E-mail: info@vlexplus.com

The controller is the natural or legal person who, alone or together with others, determines the purposes and means of the processing of personal data (e.g. names, e-mail addresses, etc.).

Storage period

Unless a more specific storage period is specified in this data protection declaration, your personal data will remain with us until the purpose of the data processing is no longer valid. If you make a justified request for deletion or revoke your consent to data processing, your data will be deleted, unless we have other legally permissible reasons for retaining your personal data (e.g. retention periods under tax or commercial law); in the latter case, the data will be deleted when these reasons no longer apply.

Note on data transfer to the USA and other third countries

Among other things, we use tools from companies based in the USA or other third countries that are not secure according to data protection law. If these tools are active, your personal data may be transferred to these third countries and processed there. We would like to emphasise that no level of data protection comparable to that of the EU can be guaranteed in these countries. For example, American companies are obliged to hand over personal data to the security authorities without you, as the data subject, being able to take legal action against this. It cannot therefore be ruled out that the US authorities (e.g. intelligence services) process, evaluate and permanently store your data on US servers for monitoring purposes. We have no influence on these processing activities.

Withdrawal of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke the consent you have already given at any time. The legality of the data processing carried out until revocation remains unaffected by the revocation.

Right to object to data collection in specific cases and direct marketing (Art. 21 GDPR)

IF THE DATA PROCESSING IS BASED ON ART. 6 ABS. 1 LIT. E OR F DSGVO, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH THE PROCESSING IS BASED CAN BE FOUND IN THIS DATA PROTECTION DECLARATION. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA, UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING IS FOR THE PURPOSE OF ASSERTING, EXERCISING OR DEFENDING LEGAL CLAIMS (OBJECTION PURSUANT TO ARTICLE 21(1) DSGVO).

IF YOUR PERSONAL DATA ARE PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS LINKED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION PURSUANT TO SECTION 21 (2) OF THE GERMAN DATA PROTECTION ACT).

Right of recourse to the competent supervisory authority

In the event of a breach of the GDPR, data subjects have the right to appeal to a supervisory authority, in particular in the Member State of their habitual residence, their place of work or the place of the alleged breach. The right of appeal shall be without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to have the data we process automatically on the basis of your consent or in the performance of a contract delivered to you or to a third party in a common, machine-readable format. If you request the direct transfer of data to another responsible party, this will only be done to the extent that it is technically possible.

SSL or TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or requests you send to us as a site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the browser address line changes from "http://" to "https://" and by the padlock symbol in the browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Information, deletion and correction

Within the scope of the applicable legal provisions, you have the right at any time to free information about your stored personal data, its origin and recipient and the purpose of data processing and, if applicable, the right to correction or deletion of this data. You can contact us at any time regarding this and any other questions you may have on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. To do this, you can contact us at any time. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify it. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data has taken place/is taking place unlawfully, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you need it to exercise, defend or assert legal rights, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have lodged an objection pursuant to Section 21 (1) DSGVO, a balancing of your and our interests must be carried out. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data - in addition to being stored - may only be processed with your consent or for the assertion, exercise or defence of legal rights or for the protection of the rights of another natural or legal person or for reasons of an important public interest of the European Union or a Member State.

4. data collection on this website

Cookies

Our internet pages use so-called "cookies". Cookies are small text files and do not cause any damage to your terminal equipment. They are stored temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your end device. Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your end device until you delete them yourself or until they are automatically deleted by your web browser.

In some cases, cookies from third-party companies may also be stored on your terminal device when you enter our site (third-party cookies). These allow us or you to use certain services of the third party company (e.g. cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary, as some functions of the site would not work without them (e.g. the shopping cart function or viewing videos). Other cookies are used to assess user behaviour or to display advertising.

Cookies that are necessary to carry out the electronic communication process (necessary cookies) or to provide certain functions desired by the user (functional cookies, e.g. for the shopping cart function) or to optimize the website (e.g. cookies to measure the web audience) are stored on the basis of Art. 6 (1) lit. f DSGVO, unless another legal basis is specified. The website operator has a legitimate interest in storing cookies for the technically error-free and optimised provision of its services. If consent to the storage of cookies has been requested, the storage of the cookies in question is based exclusively on this consent (Art. 6 para. 1 lit. a DSGVO); consent may be revoked at any time.

You can set your browser in such a way that you are informed about the setting of cookies and allow cookies only in individual cases, exclude the acceptance of cookies for certain cases or in general and activate the automatic deletion of cookies when you close your browser. If you deactivate cookies, the functionality of this website may be limited.

If cookies are used by third-party companies or for analysis purposes, we will inform you separately about this within the framework of this data protection declaration and, if necessary, request your consent.

Consent with Usercenters

This website uses Usercentrics' consent technology to obtain your consent to the storage of certain cookies on your end device or the use of certain technologies and to document this in accordance with the Data Protection Act. The provider of this technology is Usercentrics GmbH, Sendlinger Straße 7, 80331 Munich, website: usercentrics.com/de/ (hereinafter referred to as "Usercentrics").

When you enter our website, the following personal data is transferred to Usercentrics:

  • Your consent or revocation of your consent
  • Your IP address
  • Information about your browser
  • Information about your terminal device
  • Time of your visit to the website

In addition, Usercentrics stores a cookie in your browser in order to be able to assign the consent(s) granted or their revocation. The data collected in this way is stored until you ask us to delete it, until you yourself delete the Usercentrics cookie or until the purpose of the data storage no longer applies. The mandatory legal storage obligations remain unaffected.

Usercentrics is used to obtain legally required consent for the use of certain technologies. The legal basis for this is Art. 6 para. 1 lit. c DSGVO.

Order processing

We have concluded an order processing agreement (AVV) with the aforementioned supplier. This is a contract required by the Data Protection Act, which guarantees that this provider processes the personal data of visitors to our website only in accordance with our instructions and in compliance with the DSGVO.

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • browser type and version
  • Operating system used
  • Referring URL
  • Host name of the accessing computer
  • Time of server request
  • IP address

This data is not merged with other data sources.

The collection of this data is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in the technically error-free presentation and optimisation of his website - for this purpose, server log files must be collected.

Contact form

If you send us enquiries via the contact form, your data from the enquiry form, including the contact data you provide us with, will be stored by us for the purpose of processing the enquiry and in the event of subsequent enquiries. We do not pass on this data without your consent.

The processing of this data is based on Art. 6 (1) lit. b DSGVO if your request is related to the execution of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of the requests made to us (Art. 6 (1) (f) DSGVO) or on your consent (Art. 6 (1) (a) DSGVO) if this has been requested.

The data entered in the contact form will remain with us until you ask us to delete it, revoke your consent to store it or the purpose of storing the data is no longer valid (e.g., after we have completed processing your request). The mandatory legal provisions - in particular the storage periods - remain unaffected.

Request by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your request, including all personal data derived from it (name, request), will be stored and processed by us for the purpose of processing your request.

The data you send us through contact requests will remain with us until you ask us to delete it, revoke your consent to store it or the purpose for storing the data is no longer valid (e.g. after your request has been processed). The mandatory statutory provisions - in particular the statutory storage periods - remain unaffected.

Newsletter

(1) With your consent, you can subscribe to our newsletter, with which we inform you about our current interesting offers. The advertised goods and services are named in the declaration of consent.

(2) We use the so-called double-opt-in procedure to subscribe to our newsletter. This means that after your registration, we will send you an e-mail to the e-mail address you provided, in which we ask you to confirm that you wish to receive the newsletter. If you do not confirm your registration, your information will not be processed further and will be deleted over time. In addition, we store your IP addresses and the times of registration and confirmation. The purpose of this procedure is to be able to prove your registration and, if necessary, to clarify any possible misuse of your personal data.

(3) Only your e-mail address is required for sending the newsletter. The provision of further, separately marked data is voluntary and will be used to address you personally. After your confirmation, we store your e-mail address for the purpose of sending you the newsletter. The legal basis is Art. 6 para. 1 p. 1 lit. a DSGVO.

(4) You can revoke your consent to the sending of the newsletter at any time and unsubscribe from the newsletter. You can declare the revocation by clicking on the link provided in every newsletter email or by sending a message to the contact details provided in the imprint.

(5) This website uses rapidmail to send newsletters. The provider is rapidmail GmbH, Augustinerplatz 2, 79098 Freiburg i.Br., Germany.

The data you enter for the purpose of receiving the newsletter will be stored on rapidmail's servers in Germany. For the purpose of analysis, the e-mails sent with rapidmail contain a so-called "tracking pixel", which connects to the servers of rapidmail when the e-mail is opened. In this way, it can be determined whether a newsletter message has been opened. With the help of rapidmail, we can determine whether and which links in the newsletter message are clicked. All links in the e-mail are so-called tracking links, with which your clicks can be counted. You can find out more about the analysis functions of rapidmail by clicking on the following link: de.rapidmail.wiki/kategorien/statistiken/.

The data you provide for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from our servers as well as from the servers of rapidmail after you unsubscribe from the newsletter. For more details, please refer to the data protection ttps://www.rapidmail.de/datensicherheit.

We have concluded a contract with rapidmail in which we oblige rapidmail to protect our customers' data and not to pass it on to third parties.

Registration Download Area

(1) You have the option of registering for our download area and thus creating a user profile. In the course of registration and set-up, we collect and use the following personal data: E-mail address, first and last name and company. Mandatory data provided for the purpose of registration are marked with an asterisk in the input mask as mandatory fields.

(2) The registration is activated manually by one of our employees. In addition, we store your IP addresses used and the time of registration. The purpose of this procedure is to be able to prove your registration and, if necessary, to clarify a possible misuse of your personal data.

(3) Your user account gives you the opportunity to use other parts of our website and to log in. The legal basis for data processing is Art. 6 para. 1 lit. a DSGVO in the case of consent or Art. 6 para. 1 lit. b DSGVO if the processing is necessary to provide the requested services.

(4) You can initiate a change and/or deletion of your user account, including the data you have provided, by sending an e-mail to mitglied@vlexplus.com, insofar as there are no legal obligations to retain data.

5. analysis and advertising tools

Use of SalesViewer® technology

On this website, data is collected and stored for marketing, market research and optimisation purposes using the SalesViewer® technology of SalesViewer® GmbH on the basis of the legitimate interests of the website operator (Art. 6 para.1 lit.f DSGVO).

For this purpose, a javascript-based code is used to collect company-related data and the corresponding use. The data collected with this technology is encrypted via a non-reversible one-way function (so-called hashing). The data is immediately pseudonymised and not used to personally identify the visitor to this website.

The data stored within the framework of Salesviewer will be deleted as soon as it is no longer required for its intended purpose and there are no legal obligations to retain data to prevent its deletion.

You can object to the collection and storage of data at any time with effect for the future by clicking on this link here to prevent the collection of data by SalesViewer® within this website in the future. This will place an opt-out cookie for this website on your device. If you delete your cookies in this browser, you must click this link again.

Matomo (formerly Piwik)

This site uses the Matomo open source web analysis service. Matomo uses technologies that enable user recognition across pages for the analysis of user behaviour (e.g. cookies or device fingerprinting). The information collected by Matomo about the use of this website is stored on our server. The IP address is anonymised before storage.

With the help of Matomo, we are able to collect and analyse data on visitors' use of our website. This allows us to know, among other things, when page views were made and from which region they came. We also collect various log files (e.g. IP address, referrers, browsers and operating systems used) and can measure whether visitors to our website perform certain actions (e.g. clicks, purchases, etc.).

The use of this analysis tool is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in the anonymised analysis of user behaviour in order to optimise both its website and its advertising. If a corresponding consent has been requested (e.g. consent to the storage of cookies), the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO; the consent can be revoked at any time.

IP anonymisation

We use IP anonymisation for analysis with Matomo. Your IP address is shortened before analysis so that it can no longer be clearly assigned to you.

Hosting

We host Matomo exclusively on our servers so that all analysis data remains with us and is not passed on.

6. plugins and tools

YouTube with extended data protection

This website incorporates videos from YouTube. The operator of the pages is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in extended data protection mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this website before they watch the video. However, the transfer of data to YouTube's partners is not necessarily excluded from the extended data protection mode. Thus, regardless of whether you watch a video, YouTube establishes a connection with the Google DoubleClick network.

As soon as you start a YouTube video on this site, a connection is established with the YouTube servers. This tells the YouTube server which of our pages you have visited. If you are logged into your YouTube account, you allow YouTube to assign your surfing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account.

In addition, after you start a video, YouTube may save various cookies on your end device or use comparable recognition technologies (e.g., your device's fingerprint). In this way, YouTube can obtain information about visitors to this website. This information is used, among other things, to gather video statistics, improve user experience and prevent fraud attempts.

If necessary, further data processing processes may be triggered after a YouTube video begins, over which we have no control.

YouTube is used in the interest of an attractive presentation of our online offers. This represents a legitimate interest in the sense of Art. 6 para. 1 lit. f DSGVO. Insofar as corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO; consent can be revoked at any time.

Further information on data protection on YouTube can be found in their privacy policy at: policies.google.com/privacy.

Google Web Fonts (local hosting)

This website uses so-called web fonts provided by Google for the uniform display of characters. Google Fonts are installed locally. There is no connection to Google's servers.

More information about Google Web Fonts can be found at developers.google.com/fonts/faq and in Google's privacy policy: policies.google.com/privacy.

Font Awesome (locally hosted)

This site uses Font Awesome for consistent display of fonts. Font Awesome is installed locally. A connection to the servers of Fonticons, Inc. does not take place.

For more information about Font Awesome, please see the Font Awesome privacy policy at: fontawesome.com/privacy.

Google Maps

This website uses the Google Maps service. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

In order to use the features of Google Maps, it is necessary to store your IP address. This information is usually transferred to a Google server in the USA and stored there. The provider of this website has no influence on this data transfer. If Google Maps is activated, Google may use Google Web Fonts for the uniform display of fonts. When you call up Google Maps, your browser loads the necessary web fonts into your browser cache to display texts and fonts correctly.

The use of Google Maps is in the interest of an attractive presentation of our online offers and an easy localisation of the places we show on the website. This represents a legitimate interest within the meaning of Art. 6 para. 1 lit. f DSGVO. Insofar as corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a DSGVO; consent may be revoked at any time.

The transfer of data to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: privacy.google.com/businesses/gdprcontrollerterms/ and privacy.google.com/businesses/gdprcontrollerterms/sccs/.

More information on the processing of user data can be found in Google's privacy policy: policies.google.com/privacy.
